Indian software services firms Wipro and HCL Technologies will join global firms IBM, HP and CSC in a bid to snare an IT consolidation project of ArcelorMittal, the world’s largest steelmaker. The deal is expected to be worth up to euro 400 million

The project, which aims to consolidate ArcelorMittal’s IT infrastructure across Europe, has the potential to be one of the largest in the region for the Indian software sector. It could also provide a firm foothold in a market that is receiving greater attention from domestic outsourcing companies.
According to sources, Brussels-based global sourcing advisory Quantum Step is advising ArcelorMittal on the deal. However, when contacted, a spokesperson for Quantum Step declined to comment. An email sent to ArcelorMittal’s India office did not elicit any response. Calls to its UK office went unanswered.

“ArcelorMittal has not so far outsourced any of its IT projects. It was only earlier this year that Bangalore-based Wipro won a five-year engagement with the company to consolidate its messaging systems. This shows the potential that IT vendors have to tap the European market,” said an analyst on condition of anonymity.

As an incumbent vendor, Wipro could have an edge. The company will help ArcelorMittal consolidate and migrate its messaging systems to the Microsoft Exchange 2010 platform, hosted at six data centres spanning North America, Latin America, East and West Europe and Asia.

Deals such as this reflect not only the growing need of European companies to outsource work, but also the growing focus on the European region by Indian outsourcing firms. Recently, India’s largest IT services provider, Tata Consultancy Services, was reconfirmed a £600-million project to administer the National Employee Savings Trust by UK’s NEST Corporation.

According to a recent study by Everest Group, the European global outsourcing market is estimated to be worth $26-30 billion, or just under a third of the global market. So far, Europe’s contribution to Indian IT services revenues is 25-30 per cent.

“However, the potential of the European sourcing opportunity by 2020 is estimated to be $250-300 billion, which is 10 to 11 times the current size. So far, it has been an untapped region, with service providers, including Indian players, focusing more on the UK and some other regions,” said H Karthik, vice-president, Everest Group.

The Everest report also stated that of Europe’s $26-30-billion outsourcing market, IT accounts for the largest chunk, 61 per cent, followed by business process outsourcing at 39 per cent. Karthik points out that by 2020 markets like the UK, Germany and France will constitute 55 per cent of the European sourcing market, followed by Nordic countries, Italy and Benelux.

Logitech stalls Google TV shipments, awaiting better software

Logitech is apparently unhappy enough with the Google TV software on its Revue set-top box that it has suspended shipments of the system, according to the Taiwanese tech biz gossip rag DigiTimes.
When the Revue came out in October — along with Sony’s Internet TV products, also powered by Google TV — we said flat out that the software was only half baked. Most other reviewers agreed, and Google TV made many “worst of 2010″ lists. Google allegedly asked new hardware partners to hold off on releasing new Google TV products, so it makes sense that Logitech puts on the brakes, too, given a lack of confidence in the product coming from within Google itself.
(Logitech has not yet responded to our inquiry, possibly due to the holiday schedule.)
So what’s so bad about Google TV? There are two main issues, one that Google can solve in house, one that will require diplomacy. First, Google needs to fix the user interface, so that there is a clearer distinction between using “apps” and browsing the Web. Next, they need to smooth out their relationships with TV and movie content owners so that Google TV can actually play the “free” ad-supported content out on the Web. (It is currently blocked from doing so.) Moving forward, Google needs to encourage the development of unique Google TV apps, and integrate those apps into its video search feature.
If you want more details, read my review, but it should suffice to say that the platform is plenty flawed. We applaud Logitech for putting its foot down — better late than never. The only remaining mystery is why Samsung would unveil its Google TV product at the Consumer Electronics Show in Las Vegas next week, given all of the controversy. Let’s hope that is one rumor that will be put to rest, at least until Google TV gets better.

CPI caution against use of foreign software

In a letter to Prime Minister Manmohan Singh, the Communist Party of India has raised the issue of sensitive government departments opting for foreign software, with their attendant security implications, over indigenous solutions.

CPI leader Gurudas Dasgupta alleged that tender specifications for three mega software projects were tailored to suit foreign multi-national companies and block Indian product vendors.

The three projects pertain to defence forces, the Indian Railways and the Power Grid Corporation (PGC).

In an earlier letter to the Prime Minister, he had highlighted three similar cases in the Indian Air Force, Coal India and Department of Posts as “examples for immediate action.”

On the high security defence projects, Mr. Dasgupta pointed out that both tenders – for Naval Aviation Management System and the Indian Army’s Computerised Inventory Control Project – should be cancelled. The government should instead offer these projects for competition among Indian companies, with the intellectual property rights resting within the country.

In the case of the Army project, “the tender and selection process were designed in a manner that only foreign MNC products could be offered. All the participating Indian companies were offering products by MNCs with the source code resting with the foreign company. This way we increase the risk of letting out sensitive defence and country-specific secrets. These products will also be dependent on foreign multinationals for support and upgrades.”

“Further, in the event of sanctions being imposed on the country by a foreign nation that also happens to be the software supplier, the situation will be aggravated further,” warned Mr. Dasgupta while seeking Indian alternatives for the naval project.

The human resource management project of the Indian Railways will hold critical information about over 1 million employees. “For such strategic projects there should be healthy competition in the tendering process, not just restricted to products owned by foreign MNCs. Moreover, software products developed by Indian companies should be encouraged,” he wrote to the Prime Minister.

In the case of PGC, which transmitted nearly half the power generated in the country, the CPI leader said the tender evaluation criteria for automating all its critical business processes “smack of corruption.”

He referred to four clauses including two that state that the software vendor with the maximum turnover would be given the highest score. In addition, the software tender includes some “cleverly worded” clauses for the selection of a software implementation partner. These essentially imply that even if top Indian IT companies wanted to submit their bids, they would qualify only if they offered software products owned by large foreign MNCs and not Indian software products.

Stateless kids ’still lose out’ in education

The government should ratify the Convention against Discrimination in Education to ensure that stateless children get a proper education, say child rights advocates.

Surapong Kongchantuek, head of the Lawyers Council’s human rights subcommittee on ethic minorities, the stateless, migrant workers and displaced persons, said many stateless children, especially those in border areas, still have no access to education.

That’s despite the fact that several regulations had been put in place to guarantee their right to schooling.

“Some are allowed to study but no certificates are granted to them after graduation,” he told a meeting of child rights activists and legal experts held in Bangkok recently.

The participants agreed that the government’s ratification of the Convention against Discrimination in Education, which 98 countries have now joined, would help improve the situation.

“The government’s policy [on education for stateless children] is fine, but the problem is that it has not been turned into action,” Mr Surapong said.

“Some teachers or people involved in education do not even know that unregistered children are allowed to have schooling.

“The convention might help tackle the problem.”

He called on the Education Ministry to be the focal point in studying the ratification proposal and in submitting the study for cabinet consideration.

Johan Lindeberg, a specialist on education at the Regional Bureau of Education for Asia and the Pacific, the United Nations Educational, Scientific and Cultural Organisation (Unesco), said the convention’s purposes were the elimination and prevention of discrimination and equality of opportunity.

Ratifying the convention might not end discrimination in education against stateless children, but would give the government directions and guidelines over what steps they should take to tackle it, he said.

How to classify software maintenance

The service taxability of supply of software of all kinds has always been an area of controversy and dispute. This is primarily due to the very nature of the industry, which does not fit in very well with India’s indirect taxation system which envisages transactions with a well defined consideration for each such transaction, whether it is of supply or sale of goods. This article addresses the particular issue of taxability of maintenance of software, which has seen a fair amount of change and volatility, with exemptions and clarifications being issued and withdrawn over a period of time.

In a recent decision, in the case of M/s SAP India Pvt. Ltd. Vs Commissioner of Central Excise, Bangalore [2010-TIOL-1569], the Bangalore Bench of the Tribunal had occasion to deal with the taxability of maintenance of software. The point before the Tribunal was whether maintenance of software would be covered under the taxable category of Information Technology Software Services (ITSS), which came into effect from 16 May 2008, or under the taxable category of management, maintenance or repair services which was subject to service tax even during the period prior to the above date.

While deciding the matter in favour of the appellants, the Tribunal examined in detail the various services rendered by them to their customers in relation to the software that already stood installed in the computer systems of such customers. The Tribunal also examined the literature filed by the revenue to comprehend the nature of the services so rendered. The relevant extract of the definition of ERP maintenance clearly established that software maintenance was far more than merely “fixing mistakes”. Reference was invited to the definition of ‘maintenance’, which included four activities that were undertaken after a software program was released for use:
