Lawsuit claims NYC stole 9/11 DNA software secrets

A software company that helped identify the remains of 9/11 victims is accusing the New York City Medical Examiner’s Office of handing its secrets over to the FBI.

A Manhattan federal judge has been asked to decide if the lawsuit, filed in March by the Ann Arbor, Mich.-based Gene Codes, can go forward, The New York Times reported Saturday. New York City has filed a countersuit claiming Gene Codes didn’t meet its contractual obligations.

Gene Codes’ software, known as the Mass-Fatality Identification System, helped the city analyze and organize the DNA of victims of the terrorist attack. Both sides signed a three-year contract in 2002, for which the city said it paid $13 million.

The company claims that after the contract expired, New York refused to pay it to maintain the system, then gave the FBI proprietary information once the system crashed. The city claims Gene Codes had agreed to upgrade the system for free after the city’s initial investment, and when the company didn’t follow through, it was necessary to move the information to the FBI’s database.

In court filings, the city claimed it had co-created the system by giving the company access to its database of 9/11 victims’ DNA data and giving the company guidance on system updates.

Hackers target Halloween search terms

Several leading security firms, including CyberDefender, Blue Coat, Panda Software and BitDefender, warned attackers were targeting users searching online for Halloween-related topics.

The Internet security vendor joined several other security firms, including Blue Coat and BitDefender, to warn users searching online for Halloween-related topics.

“Popular search terms have always been a target for cyber-criminals,” said Achal Khetarpal, director of CyberDefender Research Labs.

CyberDefender identified a fake anti-virus Trojan downloader infecting pages that come up when searching for Halloween costumes. When users land on these infected pages, the fake anti-virus installer hijacks the user’s Web browser and initiates a malicious process, CyberDefender said. The infected PC becomes sluggish and slow-performing while exposing personal data, according to the company.

One form, identified by Panda Labs, displays a fake video player page and asks the user to download a codec in order to play the video.

Popular search terms reflect what users are interested in at that time, making it a lucrative target. Criminals often create pages that are highly search engine optimized, with keywords reflecting currently popular search terms, said Khetarpal.

Called SEO poisoning, hackers create these pages that Google and other search engines pick up thinking they are legitimate, and return them when users type in the search terms, said CyberDefender.

According to Panda Labs, searching for Halloween costumes, Halloween decorations, Halloween ideas, Adult Halloween costumes, and Free pumpkin pattern, can return search results with malicious links.

Blue Coat said clicking on the infected link lands users on a page hosted within a hacked blog, which then redirects users to a malware distribution site. Users are presented with a download for an executable file with a name that was constructed based on the original search term, said Blue Coat. For example, users typing “Regis and Kelly Halloween show” in the search engine will see a filename like “regis-and-kelly-halloween-show-2009-to-play-40064,” or “office appropriate Halloween costumes” returning “office-appropriate-halloween-costumes-to-play-40064,” said Blue Coat.

According to the screenshot of malicious search results posted on the Panda Labs blog, the listed URL looks legitimate, with phrases like “halloween-costumes” embedded in the URL, and the page name also looks relevant, such as “Viking Halloween costume.” The description is a giveaway, since it seems to not have anything to do with the page.

According to BitDefender, “If you’re planning to find templates for Halloween invitations, or if you’re trying to find a print shop for what you already have, then you should keep an eye on what search results you’re about to click.”

Khetarpal advised users to manually type the Web site URL, instead of just clicking on links displayed on the Google search results page. For example, if the search results page show a Halloween costume at Target, users should type target.com in the address bar and search within the store’s Web site instead of clicking on the link directly. This way, users won’t be re-directed to an infected site, Khetarpal said.

“Users should only click trusted links or type in the site address they want into the search bar,” he said.

Spammers and hackers often take advantage of current events, popular trends, and holidays like Halloween to target users. For example, there tends to be surge in the volume of spam with Super Bowl-related subject lines. According to Khetarpal, holidays and celebrities are “hot topics” and “prime targets” for malware authors.

Khetarpal and other security experts advised users to verify they have a security software suite installed on the computer before going online, let alone searching for something. The suite should be updated to its most recent version, and the operating system should be patched with the latest updates, they said.

Google has spent $1.6 billion on 40 deals this year

Google has said this week that they have spent $1.6 billion on 40 acquisitions this year, with more expected.
The search giant revealed the number via a regulatory filing.

Google’s largest acquisition this year has been the massive $861 million purchase of mobile advertising company AdMob, which was easily integrated into Android.

The company also purchased social gaming company Slide for $180 million and video software developer On2 for $123 million.

That $1.6 billion figure could jump substantially if Google’s proposed $700 million acquisition of airline travel software company ITA Software is completed. The purchase is pending as EU and U.S. anti-monopoly regulators look at it.

Four ETFs to play Microsoft’s income jump

Core products pushed revenues and net income up at Microsoft in the third quarter, further extending out the exceptional earnings season witnessed by the technology giants and giving further support to the Software HOLDERs ETF , the iShares Dow Jones US Technology and the Technology Select Sector SPDR and the Vanguard Information Technology ETF .

According to Microsoft’s Chief Financial Officer, demand for both Windows and Office products have thrived as businesses of all sizes increased technology purchases. Furthermore, a new version of Microsoft’s flagship software, Windows 7, has sold more than 240 million licenses since its debut a year ago, making it the fastest selling operating system in the company’s history. Another factor that aided in Microsoft’s performance was sales of Office 2010 which generated $5.13 billion in the quarter and, similar to Windows 7, sold 20 percent more units since the product’s launch that it did of the previous version of Office during the same time period.

As for the future of Microsoft, fundamentals remain strong in that the Redmond, Washington based company is sitting on a boat load of cash and demand for its software products remains insatiable. Additionally, Microsoft is forming new partnerships and launching new products that could potentially give it another boost. Most recently, Microsoft completed the transition of search advertisers from Yahoo (YHOO: 16.49 +0.09 +0.55%) to Microsoft’s online ad system, plans to start selling its Kinect device for its Xbox 360 game consoles and expects its Windows 7 operating system for mobile phones to go on sale next month.

Software licensing payments are royalty and taxable, rules Tribunal

The Delhi Income-Tax Appellate Tribunal (ITAT) has held that payments received by Microsoft Corporation from end users (in India) through distributors for sale of Microsoft software, are taxable as royalty. This would be applicable for all the payments made before January 1, 1999, the ITAT has said.

Until this date, Microsoft Corporation, a US company, had direct arrangements with various Indian distributors for sale of Microsoft software (off- the-shelf/shrink-wrapped), on a principal-to-principal basis.

From January 1, 1999, the business model was changed and Microsoft granted exclusive licence to Gracemac Corporation of the US to manufacture the Microsoft software and distribute it in terms of the licence agreement. Even under the changed business model, the ITAT has now held that payments for software licensing should be treated as royalty for tax purposes.

Disposing a batch of appeals relating to three different entities — Microsoft Corporation, Gracemac Corporation and Microsoft Regional Sales Corporation (MRSC) — relating to different assessment years, the ITAT bench upheld the ruling of CIT (appeals) that consideration received from licensing of computer software would be in the nature of royalty under the Indian Income Tax law and India-US DTAA.

Revenue Dept

This ITAT ruling comes in the Revenue Department’s favour. Microsoft has been contending that payments made towards licensing of computer software cannot be treated as royalty, but should be considered as business profits. If considered as business profits, the software major would have had no tax liability here as it does not have a permanent establishment in India.

Meanwhile, in the case of Gracemac Corp, the ITAT has held that payments made in respect of copyright in Microsoft software are taxable as royalty in its hands.

Under Microsoft’s changed business model from January 1, 1999, Gracemac had entered into a licence agreement with Microsoft Operations Pte Ltd, a Singapore-based wholly-owned subsidiary of Microsoft Corporation, for non-exclusive licence to reproduce Microsoft software in Singapore. Microsoft Operations sold all its Microsoft software copies to MRSC branch in Singapore. MRSC had delivered Microsoft software copies to Indian distributors, ex-warehouse in Singapore, who in turn sold them to re-sellers/end users in India.

Microsoft Operations paid royalty to Gracemac. The royalty was based on a percentage of net selling price received by MRSC from distributors in various countries, including India.

The Delhi ITAT has also ruled that MRSC cannot be taxed again on the same income, by way of royalty, for exploitation of same rights which had been taxed in the hands of Gracemac Corporation. Any such move would constitute double taxation and therefore the ITAT has deleted the additions in the hands of MRSC for all the three years.
